Terms and Conditions

Welcome to SmallJobs.ro. These Terms and Conditions ('Terms') govern your access to and use of SmallJobs.ro ('Platform', 'we', 'us', or 'our'), operated by SmallJobs SRL, a company registered in Romania with its registered office at Simeria, Str. Progresului, Nr. 43, Hunedoara County, Romania. The Platform is an online intermediary service that connects individuals and legal entities ('Users', including job posters 'Posters' and service providers 'Providers') for posting small job tasks ('Postings'), submitting applications, direct messaging, reviews, ratings, and related features ('Services'). By accessing the Platform, registering an account, posting or applying for jobs, sending messages, submitting reviews, or otherwise using any Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (available at /privacy-policy and incorporated herein by reference), and all applicable laws and regulations. If you are using the Platform on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform or Services. These Terms, together with the Privacy Policy, form a legally binding contract between you and SmallJobs SRL.

SmallJobs SRL, as the operator and data controller for personal data processed through the Platform, is committed to compliance with the General Data Protection Regulation (EU) 2016/679 ('GDPR'), Romania's implementing Law No. 190/2018, the Digital Services Act (EU) 2022/2065 ('DSA'), the Unfair Commercial Practices Directive (2005/29/EC) as transposed in Romanian Law No. 363/2007, and other relevant EU and Romanian legislation, including the e-Commerce Directive (2000/31/EC) implemented via Romanian Law No. 365/2002, the Consumer Rights Directive (2011/83/EU) via Law No. 449/2003, electronic communications rules (Law No. 506/2004), and intellectual property protections (Law No. 8/1996). As an intermediary under DSA Article 6, we facilitate User interactions but do not create or endorse User Content (e.g., Postings, applications, reviews). For data protection details, including our use of cookies and analytics, please see the Privacy Policy.

Acceptance occurs upon: (1) clicking 'Accept' or checking the terms acceptance box during registration; (2) submitting your first Posting or application; (3) uploading Content (e.g., a profile photo or job images); or (4) using features such as social login (via Google, Facebook, or Apple), the SmallJobs mobile application, or geolocation-based search. During registration, you must explicitly check the terms acceptance box, which includes consent for essential data processing. By accepting, you affirm compliance with all Terms, including age requirements, and grant necessary licenses (see Section 11).

You must be at least 18 years old to use the Platform fully. Users aged 14-17 require verifiable parental or guardian consent, as required by Romanian Law No. 190/2018 (Article 11) implementing GDPR Article 8. Minors under 14 are strictly prohibited from registering or using Services. We may request age verification for certain features or when suspicious activity is detected. Parents and guardians are responsible for supervising minors' use of the Platform.

Updates to Terms (see Section 15) may be made for legal compliance, operational improvements, or safety reasons. Continued use after updates constitutes acceptance; we recommend reviewing the Terms periodically.

1. Description of the Services

SmallJobs.ro is an online intermediary platform enabling Users to connect for small, local job tasks in Romania, such as repairs, cleaning, gardening, tutoring, transport, or other minor services. Posters can create detailed Postings including title, description, category, budget, deadline, location (city, county, or precise geolocation for radius-based matching), and image attachments. Providers can browse and search Postings using filters, keywords, and location-based search, then submit applications with a cover message and proposed terms. The Platform is delivered as a responsive web application, an installable Progressive Web App (PWA), and a native mobile application for Android and iOS distributed via the Google Play Store and the Apple App Store; specific mobile-related terms are set out in Section 19. The Platform also provides: (a) a messaging system for direct communication between Users (with a 125-day retention window for conversations); (b) a review and rating system (1-5 stars with comments); (c) user profiles with optional photo upload, an optional public profile page, and an optional custom profile URL identifier; (d) push notifications via web push and Firebase Cloud Messaging, plus email notifications for new applications, messages, and platform updates; (e) multilingual support in Romanian and English; (f) an AI-powered assistant to help Users draft job descriptions and applications (see Section 16); (g) optional paid tier subscriptions and promoted listings processed through Netopia mobilPay (see Section 17); (h) a directory of craftsmen and a favorites system; and (i) occasional promotional raffles (the "Tombola") governed by separate Tombola Terms shown when participating. While paid tiers and promoted listings are charged services, all agreements relating to the underlying job (price, schedule, payment between Poster and Provider) are made directly between Users off-platform. We do not employ Providers, guarantee job quality or safety, set prices, or facilitate payments between Users. The Platform is generally available 24/7, subject to scheduled maintenance and to the force-majeure provisions of Section 21. We reserve the right to limit, withdraw, or change features by region, by User type, by tier, or for legal or operational reasons.

2. Acceptance of Terms

By completing registration (providing your email and name, verifying via confirmation email, or linking a social account via Google, Facebook, or Apple), submitting your first Posting or application, uploading Content, or engaging in messaging or reviews, you unconditionally accept these Terms in full, including the Privacy Policy. Registration requires explicit checkbox consent. Failure to agree prevents access to the Platform. For social logins, you consent to sharing basic profile data (name, email, profile picture, and — for Apple Sign-In — an Apple-issued identifier and optionally a private relay email address) with the Platform as part of the authentication process. If you sign in from the SmallJobs mobile application, you may use a one-time secure handoff to access the same account on the web, and the resulting web session is also bound by these Terms. Acceptance is irrevocable during use but may be terminated as described in Section 13.

We may amend these Terms at any time for reasons including legal updates, operational enhancements, safety measures, or regulatory compliance. Minor amendments (e.g., clarifications, non-material additions) take effect immediately upon publication with a new 'Last Updated' date. Material changes (e.g., those affecting your rights, liabilities, data processing, or core Services) will be notified at least 30 days in advance via email to your registered address or through an in-app notification. You will have 30 days to object or terminate your account (Section 13) without penalty. Continued use after the effective date constitutes acceptance. If any change conflicts with mandatory law, the law prevails.

3. User Responsibilities and Representations

You are solely responsible for all aspects of your use of the Platform and Services, including the accuracy, legality, and appropriateness of any Content you post or share. By using the Platform, you represent and warrant that: (a) all information you provide is true, complete, current, and not misleading; (b) you comply with all applicable laws, including Romanian and EU regulations; (c) your use is ethical and non-abusive (e.g., no harassment in messages, no spam, no unauthorized commercial promotions); (d) you will independently verify and assess other Users before entering into any agreement; and (e) you have obtained any necessary consents for information you share. You agree to promptly update any inaccurate or outdated information. Breach of these representations may result in immediate suspension or termination.

  • You must maintain accurate, up-to-date profile information at all times (e.g., name, email, phone number, location). Inaccurate profile data may lead to service disruptions, mismatched search results, and may result in account suspension or termination.
  • All Postings, applications, messages, and reviews must accurately describe tasks, services, experiences, and terms. No misleading, exaggerated, or incomplete Content is permitted. You are liable for any damages resulting from inaccurate Content.
  • Your Content and use must comply with Romanian and EU laws, including anti-discrimination laws (Law No. 202/2002), intellectual property rights (Law No. 8/1996), consumer protection (Law No. 363/2007), DSA obligations, and GDPR requirements. Prohibited activities include promoting illegal services, fraud, or tasks that endanger safety. Violations may be reported to the relevant authorities.
  • You agree to indemnify, defend, and hold harmless SmallJobs SRL, its affiliates, officers, and agents from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) your breach of these Terms; (ii) your Content; (iii) disputes with other Users; or (iv) violations of law. This indemnity survives termination.

4. Posting, Storage, and Communications

Upon submission and approval (Section 10), Postings are published and visible to other Users for up to 30 days from the posting date. Expired Postings are automatically removed from public view but may be retained internally for legal and operational purposes. You may edit active Postings but cannot delete them after applications have been submitted without notifying applicants.

We store User Content (e.g., Postings, applications, messages, reviews, profile data, images) as needed for operational, legal, and dispute resolution purposes. Content is hosted on servers within the European Union with appropriate security measures including encryption. Even after account termination, we may retain anonymized or aggregated data, or specific items required by law or for ongoing disputes. You grant us rights to store and process your Content as described in Section 11.

We may use anonymized or aggregated User Content (e.g., statistics on popular job categories, sample Postings without personal identifiers) for marketing, promotional, or research purposes without additional compensation or notice, as permitted under legitimate interests (GDPR Article 6(1)(f)). We do not sell personal data.

By using the Platform, you consent to receiving the following communications:

  • Transactional emails essential for the Services (e.g., application notifications, message alerts, review reminders, password resets). These are necessary for contract performance (GDPR Article 6(1)(b)) and cannot be opted out of without disabling related features.
  • Promotional or informational newsletters (e.g., platform updates, job tips). Opt-in required at registration or via profile settings. You may unsubscribe at any time via the one-click link in every email.
  • Occasional emails with relevant partner content. Sent only with your explicit opt-in consent. Partners do not receive your personal data without your separate consent.
  • All marketing emails comply with opt-out requirements. Transactional emails are exempt. Email frequency is limited. Contact support if you experience any issues.

5. Platform Moderation, Violations, and Enforcement

We reserve the right, at our sole discretion, to: (a) remove, edit, or refuse to publish any Content that violates these Terms, applicable laws, or community standards; (b) suspend or limit account access or features; or (c) terminate accounts permanently for severe or repeated violations. Actions may be based on automated detection, user reports, or manual review.

Upon detecting a violation, we may issue warnings (first offense), temporary suspensions (e.g., 7-30 days), or permanent bans (e.g., for fraud or hate speech). Suspended accounts retain read-only access. We will notify you via email with reasons for the action and information about the appeal process. Appeals may be submitted to contact@smalljobs.ro within 7 days and will be reviewed within 5-10 business days.

Suspension duration depends on severity: warnings carry no downtime, temporary suspensions are proportional to the violation, and permanent bans are irrevocable except by court order. We report severe violations to the relevant authorities without delay (e.g., ANSPDCP for data breaches, law enforcement for criminal activity, consumer protection agencies for misleading content).

Prohibited Content or conduct includes, but is not limited to::

  • Any discriminatory, racist, pornographic, defamatory, threatening, or violent material, including hate speech targeting protected characteristics.
  • Aggressive, harassing, intimidating, or bullying statements in messages, reviews, or Postings.
  • Misleading advertisements, false job descriptions, or promotions of restricted goods and services.
  • Intellectual property infringements, spam, unsolicited solicitations, chain letters, or unauthorized commercial advertising.
  • Content that breaches Romanian or EU laws or infringes on others' rights, including privacy violations, child exploitation (reported to authorities immediately), or promotion of illegal goods or services.
  • Misleading, deceptive, or fictitious Postings or applications designed to scam or deceive other Users.
  • Any other illegal, unsafe, abusive, or disruptive use, including tasks involving violence, hazardous materials, unlicensed professional services, excessive spamming, or attempts to exploit security vulnerabilities (e.g., phishing).

SmallJobs SRL disclaims all liability for the consequences of Content removal, account suspension, or termination, including any indirect losses. Users bear full responsibility for their Content and conduct. Appeal decisions are final unless overturned by court order. Repeated violations may result in permanent exclusion from all Services.

6. Intermediary Role and No Liability for User Agreements

SmallJobs.ro operates exclusively as a neutral online intermediary platform, facilitating connections between Posters and Providers. We do not create, select, or modify User Content. We do not vet, endorse, or verify Users (e.g., no background checks, skill certifications, or insurance validation), guarantee service quality or safety, mediate disputes, or assume any role in off-platform transactions. Our involvement is limited to providing the platform for connection and communication.

Postings and applications constitute non-binding expressions of interest only. No enforceable contracts are formed on the Platform. Users must negotiate and execute all agreements directly off-platform (e.g., for payments, terms, schedules). SmallJobs SRL is not a party to, guarantor of, or liable under any User agreements, including for job performance, quality, safety, payments, refunds, or disputes. Users assume all risks of off-platform interactions and are encouraged to verify credentials, use secure payment methods, and take appropriate precautions.

7. Non-Binding Nature of Platform Interactions

All interactions on the Platform - such as submitting applications, responding to Postings, or initiating conversations - are preliminary and non-binding. Posters may edit or withdraw Postings at any time before awarding a job. Providers may withdraw applications before acceptance. No liability arises from withdrawn offers, changed terms, or unfulfilled expectations.

Users are solely responsible for forming, negotiating, and performing any direct contracts with other Users. SmallJobs SRL is not a party to these contracts and bears no responsibility for their terms, execution, breaches, or outcomes. Users should conduct due diligence (e.g., check reviews and ratings) and use appropriate legal protections for high-risk tasks.

8. Disclaimers and Limitations of Liability

The Platform and Services are provided strictly 'as is' and 'as available' without any warranties of any kind, whether express, implied, statutory, or otherwise, to the fullest extent permitted by applicable law. We disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or secure operation.

  • We disclaim liability for technical interruptions, errors, or failures, including server downtime, network issues, geolocation inaccuracies, slow loading times, or browser compatibility problems. Maintenance may cause temporary unavailability.
  • We provide no guarantees regarding job completion, quality, suitability, timeliness, or results. Users assume all risks associated with hiring or providing services. Reviews and ratings are User-generated opinions and do not constitute endorsements by the Platform.
  • Small jobs may involve inherent risks (e.g., physical labor, access to private property, use of tools or chemicals). We do not insure Users, verify safety compliance, or assume responsibility for accidents, damages, or injuries. Users must take appropriate precautions, including arranging their own insurance and verifying qualifications where relevant.
  • To the maximum extent permitted by law, our total liability under these Terms is limited to 100 EUR or the amount you paid to us in the 12 months preceding the claim (whichever is greater). We are not liable for indirect, incidental, consequential, special, or punitive damages. This limitation does not apply to liability for gross negligence, willful misconduct, or mandatory statutory protections.

9. Reviews, Ratings, and Feedback

To promote transparency and trust, we encourage Users to submit honest reviews and ratings (1-5 stars with optional text comments) after job completion. Reviews help other Users assess reliability and quality but are entirely voluntary. Your full name is displayed with your review to ensure accountability and prevent abuse.

Reviews and ratings represent the sole opinions of the submitting User and are not verified, endorsed, or adopted by us. We disclaim all responsibility for offensive, inaccurate, biased, or defamatory content in reviews. Users are responsible for the accuracy and legality of their submissions.

Users may submit public responses to reviews (subject to moderation per Section 5). Responses must be factual and non-abusive. We disclaim liability for response content.

Reviews and responses are published only after moderation (typically within 24-48 hours). Approved content is visible on the relevant User profile. We reserve the right to edit for clarity or legality, or to remove content that violates these Terms. Deleted reviews do not retroactively affect average ratings.

10. Content Review and Publication Process

User-generated Content (e.g., Postings, reviews) may undergo review before publication to ensure compliance with these Terms and applicable laws. The process may include automated pre-screening (e.g., keyword filters) and manual review for higher-risk items. Approval or rejection typically occurs within 1-24 hours. Rejections include the reason and an option to appeal via contact@smalljobs.ro (reviewed within 3-5 business days). We may edit Content minimally for clarity or safety without prior notice.

11. Intellectual Property Rights

Users retain ownership of their original Content (e.g., text descriptions, images, reviews). By submitting Content to the Platform, you grant SmallJobs SRL a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, store, display, reproduce, modify (e.g., resize images), distribute, and use the Content as necessary for operating the Services (e.g., displaying Postings in search results). This license survives account termination for previously published Content.

  • You represent and warrant that all Content you submit does not infringe third-party rights and that you have all necessary permissions. You indemnify us against all claims arising from intellectual property infringements in your Content.
  • All Platform elements - including source code, designs, logos, trademarks ('SmallJobs.ro'), databases, algorithms, and features - are our exclusive intellectual property, protected by Romanian and EU law. You are granted a limited, revocable, non-transferable license to access and use the Platform for personal, non-commercial purposes. Copying, reverse-engineering, decompiling, or creating derivative works is strictly prohibited.
  • To report intellectual property infringements, email contact@smalljobs.ro with details including the infringing URL and proof of ownership. We follow a notice-and-takedown procedure: verify the claim, notify the alleged infringer, and remove content if the claim is valid. Repeat infringers are banned.

12. Data Protection, Privacy, and Cookies

All personal data is collected, processed, and protected in accordance with our Privacy Policy. As data controller, we ensure lawful processing, storage within the European Union, and appropriate security measures including encryption. You consent to sharing certain data with other Users as part of the Services (e.g., your name and messages in conversations).

EU/EEA Users have full GDPR rights, including the right to access, rectify, erase, and port their data. Requests are processed within 30 days. Complaints may be directed to us first, and if unresolved, escalated to the Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP) at dataprotection.ro. We conduct data protection impact assessments for high-risk processing and notify data breaches within 72 hours as required by law.

The Platform uses cookies for essential functionality (e.g., authentication session, language preference) and, with your consent, for analytics. You can manage cookie preferences via the cookie banner or your browser settings. Declining non-essential cookies does not impair core Platform functionality. Full details are in the Privacy Policy.

13. Termination and Suspension

You may terminate your account at any time via your profile settings or by contacting support@smalljobs.ro. Termination is effective immediately upon confirmation.

  • Upon termination: access ceases immediately; active Postings and applications are removed from public view; personal data is deleted within 30 days per GDPR Article 17, except where retention is required by law (e.g., dispute records for up to 2 years); no further communications will be sent.
  • We may suspend (e.g., 7-30 day restriction) or terminate accounts without prior notice for: (i) violations of these Terms; (ii) prolonged inactivity (flagged after 12 months, terminated after 2 years with prior email notice); (iii) legal reasons (e.g., court order); or (iv) repeated abuse. Suspended Users may appeal per Section 5. Terminated Users may not re-register without our prior approval.
  • Post-termination: all pending applications are canceled; disputes should be resolved before account deletion where possible; Content is archived and anonymized. The following provisions survive termination: indemnities (Section 3), intellectual property licenses (Section 11), and disclaimers (Section 8).

14. Dispute Resolution and Governing Law

We encourage amicable resolution of disputes. Contact support@smalljobs.ro within 30 days of the issue with relevant details. We will attempt to mediate informally within 5 business days. If unresolved, disputes for Users in Romania are subject to binding arbitration in Bucharest under Romanian Arbitration Law No. 134/2010. For minor claims under 5,000 EUR, small claims procedures under Law No. 289/2009 apply. EU Users may also use the Online Dispute Resolution platform at ec.europa.eu/odr. Each dispute is handled individually; class actions are not permitted.

These Terms are governed exclusively by the laws of Romania. For EU Users, mandatory consumer protections apply. Exclusive jurisdiction lies with the courts of Hunedoara County (for local matters) or Bucharest (for appeals), unless arbitration applies.

15. Changes to These Terms

We may revise these Terms at any time to reflect changes in laws, technology, operations, or business needs. Minor changes take effect immediately upon publication. Material changes are notified at least 30 days in advance via email or in-app notification. You have 30 days to review, object, or terminate your account without penalty. Continued use after the effective date constitutes acceptance. If any change conflicts with mandatory law, the law prevails. Prior versions are available upon request.

16. AI-Powered Features

The Platform provides an AI-powered assistant ('AI Assistant') that helps Users draft job descriptions, refine applications, and receive suggestions for improving their content. The AI Assistant uses third-party artificial intelligence technology to generate text suggestions based on your input.

AI-generated content is provided as suggestions only and may contain inaccuracies, incomplete information, or inappropriate recommendations. You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it. The AI Assistant does not provide legal, financial, medical, or professional advice.

Use of the AI Assistant is subject to a daily usage quota per user. Once the daily limit is reached, the feature becomes unavailable until the next day. We reserve the right to modify usage limits at any time without prior notice.

When you use the AI Assistant, your input text is sent to a third-party AI service provider for processing. We do not send your personal profile data, messages, or other account information to the AI provider. The input is used solely to generate the requested suggestion. Please do not include sensitive personal data, financial information, or confidential details in your AI Assistant requests.

We disclaim all liability for the accuracy, completeness, legality, or suitability of AI-generated content. You are fully responsible for any Content you publish on the Platform, regardless of whether it was drafted with AI assistance. We are not liable for any damages, losses, or disputes arising from the use of AI-generated content.

You may not use the AI Assistant to generate content that violates these Terms (Section 5), including discriminatory, misleading, harmful, or illegal material. Attempting to manipulate the AI system to produce prohibited content may result in immediate account suspension or termination.

17. Payments and Refund Policy

SmallJobs offers optional paid services organized in tiers (currently Bronze, Silver, Gold, Diamond, and Platinum), each unlocking additional Platform features such as higher daily AI assistant quotas, more profile and job images, public-profile visibility, a custom profile URL, and other benefits described on the pricing page. Tier features and prices may be adjusted at any time, with notice for material changes. All payments are processed through Netopia mobilPay, a payment processor authorized by the National Bank of Romania. SmallJobs does not collect, see, or store your full card number, CVV, or banking credentials — those are entered exclusively on Netopia's secure payment pages. We retain only the order identifier, transaction reference, amount, currency, plan identifier, payment status, and the IPN response received from Netopia, which we use for billing, accounting (10-year retention under the Romanian Fiscal Code), tier activation, and dispute handling.

All payments are final and non-refundable. By completing a payment, you acknowledge that you are not entitled to a refund for activated monthly or annual subscriptions, regardless of actual usage during the paid period.

Monthly subscriptions are billed in advance for each one-month period. The service remains active for the full duration of the paid period.

Annual subscriptions are billed in full in advance for a 12-month period. No prorated refunds are provided for unused portions of the subscription.

Payments for profile promotion are one-time and non-refundable. The promotion service is active for the purchased duration.

Exception: If SmallJobs.ro permanently ceases operations, users with active subscriptions will receive a prorated refund for the remaining subscription period, calculated from the date of platform closure.

For any payment-related disputes, please contact us at contact@smalljobs.ro. We reserve the right to review genuinely exceptional cases individually.

18. Consumer Right of Withdrawal

If you are a consumer (a natural person acting outside your trade, business, craft, or profession) resident in the European Union, the Consumer Rights Directive (Directive 2011/83/EU, transposed into Romanian Law No. 449/2003 and amended by O.U.G. No. 34/2014) grants you a right of withdrawal of fourteen (14) calendar days from distance contracts for digital services, without giving any reason and without incurring costs other than those described in these Terms. The withdrawal period begins on the day the paid service is activated, or on the day the contract is concluded for paid services not yet activated.

By selecting a paid tier, promoted listing, or any other paid service, completing the payment, and confirming activation, you expressly request that performance begin immediately during the withdrawal period, and you expressly acknowledge that, once the service has been fully performed (for example, once a one-time promoted listing has been displayed for its full duration) or once you have started actively using a tier subscription before the end of the 14-day period, you lose your right of withdrawal under Article 16(m) of Directive 2011/83/EU and the corresponding provision of Romanian Law No. 449/2003. We make this acknowledgement an explicit step in the checkout flow, and your acknowledgement is recorded together with the order data.

If you wish to exercise the right of withdrawal within the statutory period and before service performance has been completed, send an unequivocal statement to contact@smalljobs.ro stating your intent to withdraw, your full name, your registered email address, the date and amount of the payment, and the order identifier. We will refund the amount paid using the same means of payment used in the original transaction within 14 days of receiving your withdrawal notice, unless you expressly agree to another means; you incur no fees for the refund itself.

Where the service has been partially performed before the receipt of a valid withdrawal notice, and the right of withdrawal has not yet been waived in accordance with this Section, we may charge a proportional amount corresponding to what has been performed up to the time you informed us of your withdrawal, calculated on the basis of the total contract price.

The right of withdrawal does not apply to: (i) digital content or digital services not supplied on a tangible medium where performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal (Article 16(m) of Directive 2011/83/EU); (ii) services already fully performed; (iii) goods or services whose price is dependent on fluctuations in the financial market that we cannot control; (iv) any other exception listed in Article 16 of Romanian Law No. 449/2003. The non-refund policy in Section 17 applies only after the withdrawal right has been validly waived or has expired.

A model withdrawal form, conforming to Annex I(B) of Directive 2011/83/EU, is available on request from contact@smalljobs.ro. Use of this form is not mandatory; any unequivocal statement of withdrawal sent to that address within the statutory period is sufficient.

19. Mobile Application, App Stores, and Device Permissions

The Platform is also available as a native mobile application for Android and iOS devices (the "Mobile App"). These Terms, together with the Privacy Policy, apply in full to your use of the Mobile App in addition to your use of the web Platform. By installing, accessing, or using the Mobile App, you confirm acceptance of these Terms.

The Mobile App is distributed through the Apple App Store (operated by Apple Inc.) and the Google Play Store (operated by Google LLC). Your download, installation, and use of the Mobile App are also subject to the terms of service, end-user license agreements, and privacy policies of the relevant app store. SmallJobs SRL is not a party to those agreements between you and the store operator and assumes no responsibility for them.

If you install the Mobile App from the Apple App Store, the following additional terms apply pursuant to Apple's Licensed Application End User License Agreement requirements: (a) these Terms are concluded between you and SmallJobs SRL only, and not with Apple Inc.; (b) Apple is not responsible for the Mobile App or its content; (c) Apple has no obligation to furnish maintenance and support services for the Mobile App; (d) in the event of any failure of the Mobile App to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid by you for the Mobile App, and to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Mobile App; (e) any claims relating to your use or possession of the Mobile App, including product liability claims, claims that the Mobile App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation, are the sole responsibility of SmallJobs SRL; (f) you must comply with applicable third-party terms of agreement (for example, your wireless data services agreement) when using the Mobile App; and (g) Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms in respect of your use of the Mobile App, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you install the Mobile App from the Google Play Store, your use is also governed by the Google Play Terms of Service. To the extent of any conflict between Google Play Terms and these Terms regarding your relationship with SmallJobs SRL, these Terms prevail, without prejudice to any rights granted to Google as the platform operator.

Depending on the features you use, the Mobile App may request the following device permissions: (a) Camera and Photo Library — to let you take or select images for your profile, jobs, applications, or messages; (b) Location — to let you search for jobs near you and to attach a coarse location to your postings; precise GPS coordinates are mapped immediately to a city or locality name and are not stored as raw coordinates on our servers; (c) Notifications — to deliver push notifications for messages, applications, reviews, and platform updates that you have opted into; (d) Network Access — required for the Mobile App to function; (e) Background App Refresh (iOS) or equivalent — used solely to refresh notifications and unread counters. You can grant or revoke each of these permissions at any time from your device's system settings; revoking a permission will disable only the related feature.

Paid services on the Platform (tier subscriptions, tier upgrades, and promoted listings) are processed exclusively through Netopia mobilPay using a secure webview to Netopia's payment pages. The Mobile App does not currently use Apple In-App Purchase or Google Play Billing for digital services on the Platform. If a future version of the Mobile App introduces in-app billing, the applicable terms and pricing will be presented to you in the checkout flow before any purchase is made.

We may release updates to the Mobile App to add features, fix bugs, address security issues, or comply with legal or platform requirements. We may require you to install the latest version to continue using the Mobile App. We may also discontinue support for older operating system versions when reasonably necessary; we will provide reasonable notice before doing so.

Use of the Mobile App requires a working internet connection. Your mobile network operator may charge you for data usage, including for downloads, image uploads, and push notifications; SmallJobs SRL is not responsible for any such charges.

The Mobile App may include third-party software development kits (SDKs) for crash reporting, analytics, push notifications, social authentication, and payment processing. These SDKs may collect technical information about your device (model, OS version, app version, language, network type, anonymized identifiers) for the purposes of operating, securing, and improving the Mobile App. A current list of third-party processors and their roles is included in the Privacy Policy.

The Mobile App and the web Platform share a single account. Actions taken on one are reflected on the other. A secure mobile-to-web handoff allows you to open your account in a web browser without re-entering your password; the handoff token is single-use, short-lived, and bound to your device.

By using the Mobile App, you represent and warrant that (a) you are not located in a country that is subject to a comprehensive embargo by the European Union or by the United States, and (b) you are not listed on any EU or U.S. government list of prohibited or restricted parties. This warranty is required by Apple's and Google's distribution policies.

20. Reporting Illegal Content, Notice-and-Action, and DSA Compliance

SmallJobs SRL operates the Platform as a hosting service and intermediary within the meaning of Article 6 of the Digital Services Act (Regulation (EU) 2022/2065) ("DSA"). We do not have a general obligation to monitor User Content or actively to seek facts or circumstances indicating illegal activity, but we act expeditiously to remove or disable access to illegal content once we obtain actual knowledge of it, and we cooperate with competent authorities upon receiving valid orders.

Anyone — whether a User or not — may report Content they consider illegal under EU or Romanian law (for example, counterfeit goods, hate speech, child sexual abuse material, harassment, defamation, intellectual property infringement, threats of violence) by sending an electronic notice to contact@smalljobs.ro with the subject "DSA Notice". To enable us to act, your notice should include: (i) a sufficiently substantiated explanation of the reasons why you consider the Content illegal; (ii) the exact electronic location of the Content (URL or stable identifier); (iii) your name and email address (anonymous reports are accepted only for notices alleging child sexual abuse material); and (iv) a statement confirming your good-faith belief that the information and allegations are accurate and complete. We acknowledge receipt of complete notices without undue delay and provide a reasoned decision within a reasonable timeframe taking into account the complexity and seriousness of the alleged illegality.

When we restrict the visibility of, demote, suspend, terminate, or otherwise take action against User Content, an account, or monetization, we provide the affected User with a clear and specific statement of reasons (DSA Article 17), including: the action taken and its scope and duration; the facts and circumstances relied upon; whether automated means were used in the detection or decision-making and, if so, a meaningful description of those means; the contractual or legal grounds invoked; and information about the means of redress available, including our internal complaint mechanism, certified out-of-court dispute settlement, and judicial redress. We may withhold or limit a statement of reasons where doing so would conflict with a legal order or with an ongoing investigation by a competent authority.

Affected Users may submit a free-of-charge internal complaint against any moderation decision (removal, demotion, suspension, termination, monetary or visibility restriction, or refusal to act on a notice) within six (6) months of being informed of the decision, by emailing contact@smalljobs.ro with the subject "DSA Internal Complaint". Complaints are reviewed by qualified personnel who did not take the original decision and not solely on the basis of automated means. We aim to issue a reasoned decision within fourteen (14) days, and in any event without undue delay. Manifestly unfounded or repetitive complaints may be refused after a reasoned warning.

If you disagree with the outcome of an internal complaint, you have the right (DSA Article 21) to refer the dispute to a certified out-of-court dispute settlement body of your choice. Our engagement with such a body is in good faith but the body's decisions are not binding on us; engagement does not preclude you from initiating judicial proceedings. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

Notices submitted by Trusted Flaggers awarded that status by the Romanian Digital Services Coordinator under DSA Article 22 are processed and decided with priority and without undue delay.

We may suspend, after issuing a prior reasoned warning, the provision of Services to Users who frequently provide manifestly illegal Content (DSA Article 23(1)) and to persons or entities who frequently submit notices or complaints that are manifestly unfounded (Article 23(2)). The duration of any such suspension takes into account all relevant facts and circumstances, including the seriousness of the misuse, and is communicated together with the reasons for the suspension.

Where we become aware of any information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place, or is likely to take place, we promptly inform Romanian law enforcement authorities or, where the relevant authority cannot be identified with reasonable certainty, Europol (DSA Article 18), and we provide all relevant information available to us.

We take additional protective measures regarding minors: we refuse accounts to users under 14 years of age, we require verifiable guardian consent for users 14-17 (in accordance with Romanian Law No. 190/2018 implementing GDPR Article 8), we do not present advertising based on profiling using personal data of users we know with reasonable certainty to be minors (DSA Article 28(2)), and we provide reporting channels designed to be accessible to younger Users.

Where required by the DSA, we publish annual transparency reports describing the moderation actions we have taken (Article 15), including the number and types of notices received, decisions taken, accuracy of any automated systems used, and the median time to act.

Our single point of contact for communications with EU Member States, the European Commission, and the European Board for Digital Services in relation to the application of the DSA is contact@smalljobs.ro. Communications may be addressed in Romanian or English. Our single point of contact for recipients of the Service to communicate with us under DSA Article 12 is the same email address; we accept communications in Romanian and English.

21. Force Majeure and Service Continuity

We are not liable for any failure or delay in performing our obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control ("Force Majeure"), including but not limited to: acts of God; natural disasters (earthquakes, floods, fires, severe weather, volcanic activity); war, armed conflict, terrorism, civil unrest, riot, sabotage, or vandalism; epidemics, pandemics, and public-health emergencies, including any associated quarantine, lockdown, or restriction measures; strikes, labor disputes, or work stoppages, whether involving our personnel or third parties; failure or interruption of internet backbone, undersea cables, power grid, hosting providers, content delivery networks, payment networks, telecommunications operators, or other essential third-party services; cyber-attacks, distributed denial-of-service attacks, ransomware, or malicious code outbreaks affecting infrastructure we rely upon; acts, decrees, regulations, or orders of any government or competent authority, including export controls, sanctions, or compelled disconnection; and any other event of similar character not reasonably foreseeable or avoidable by us at the time of contracting.

During a Force Majeure event, our obligations under these Terms are suspended to the extent and for the duration affected, without liability. We will use commercially reasonable efforts to mitigate the effect, to keep you informed where practical, and to resume performance as soon as reasonably possible. If a Force Majeure event continues uninterrupted for more than thirty (30) days, either party may terminate the affected Services upon written notice without liability, except for accrued obligations existing at the time of termination.

We aim to keep the Platform available 24/7 but do not guarantee uninterrupted, error-free, secure, or virus-free operation. Scheduled maintenance, security patching, infrastructure migrations, deployment of new features, and emergency interventions may cause temporary unavailability or partial degradation; we make reasonable efforts to schedule them outside peak hours and to provide advance notice of significant downtime where feasible.

We back up Platform data at regular intervals and apply reasonable security and integrity controls, but cannot guarantee zero data loss in the event of catastrophic failure, cyber-attack, or Force Majeure. You are encouraged to keep your own copies of Content that is important to you (for example, by exporting your data through the rights described in the Privacy Policy).

22. General Provisions

If any provision of these Terms is held to be invalid, illegal, or unenforceable in whole or in part by a competent court, arbitrator, or authority, that provision (or the offending part) is severed and the remaining provisions remain in full force and effect. The parties will negotiate in good faith to replace the severed provision with a valid one that, to the extent permitted by law, achieves substantially the same commercial and legal intent.

These Terms, together with the Privacy Policy, the cookie information integrated therein, the tier-specific terms applicable at the time of purchase, the Tombola Terms (where you participate in promotional raffles), and any additional written agreement we conclude with you, constitute the entire agreement between you and SmallJobs SRL regarding the Platform and supersede any prior or contemporaneous agreements, communications, representations, or understandings (whether oral or written) regarding the same subject matter, except for fraudulent misrepresentations.

No failure or delay by SmallJobs SRL in exercising any right or remedy under these Terms or in insisting on strict compliance with any provision constitutes a waiver of that right, remedy, or provision. Any waiver must be in writing and signed by an authorized representative of SmallJobs SRL to be effective. A waiver of any provision on one occasion is not a waiver of the same provision on future occasions or of any other provision.

You may not assign or transfer these Terms or any of your rights or obligations under them, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms in whole or in part to any affiliate, successor entity, or third party in connection with a merger, acquisition, reorganization, sale of assets, financing, or by operation of law, without your additional consent. We will provide reasonable notice of any material assignment that affects your rights, and you may terminate your account if you do not agree.

We may give you notices required under these Terms by email to your registered address, by in-app or in-browser notification, by banner displayed within the Platform, by posting on the Platform's website, or by any other method permitted by law. Notices to us must be sent to contact@smalljobs.ro and (for legal service of process) to the registered address listed in Section 23. You are responsible for keeping your registered email address current.

Nothing in these Terms creates a partnership, joint venture, employment, agency, franchise, or fiduciary relationship between you and SmallJobs SRL. Neither party may bind the other or incur obligations on the other's behalf without prior written authorization.

Except as expressly stated (notably Apple Inc. as a third-party beneficiary in respect of your use of the Mobile App, see Section 19), these Terms do not create any rights for, and are not enforceable by, any third party.

These Terms are issued in Romanian and English. The Romanian version is the binding original; the English version is provided for convenience. In the event of any conflict between the two language versions concerning Users domiciled in Romania, the Romanian version prevails.

Section titles, subsection labels, and headings are for convenience only and do not affect the interpretation of these Terms.

Where these Terms refer to obligations under Romanian or EU law and that law is later amended, replaced, or superseded, the reference is to the law as amended or to the corresponding successor provision. Words importing the singular include the plural and vice versa, and words importing one gender include all genders.

To the extent permitted by mandatory law, you and SmallJobs SRL agree that any dispute arising out of or relating to these Terms will be resolved on an individual basis only, and not as a class action, collective action, or representative action. This provision does not affect any non-waivable consumer right under EU or Romanian law.

The following provisions survive termination of these Terms or your account: indemnities (Section 3), payment obligations accrued before termination (Section 17), the consumer-withdrawal acknowledgements (Section 18), Apple's third-party beneficiary rights (Section 19), DSA-related rights and obligations (Section 20), force majeure (Section 21), the limitations of liability (Section 8), the intellectual property licenses you have granted (Section 11), and these General Provisions (Section 22).
