You have 14 days

If you are a consumer — a natural person acting outside their trade or profession — you may withdraw from the contract within 14 calendar days, without justifying your decision and without penalty. The period runs from the date the contract was concluded, that is from when we e-mailed you the order confirmation.

The basis is Emergency Ordinance no. 34/2014 on consumer rights, transposing Directive 2011/83/EU. This right is granted by law and cannot be removed by a contract term: Article 25 of the same ordinance provides that any clause waiving it is not binding on the consumer.

What happens if you already started using the service

At purchase we asked you to confirm two things: that you want the service to begin immediately rather than waiting out the 14 days, and that you know you will lose the right of withdrawal once the service has been fully performed. The effect of those confirmations is often misstated, so we set it out plainly.

For a monthly or annual subscription, the service is NOT fully performed on the first day — it is performed across the whole paid period. You therefore keep your right of withdrawal during the 14 days, even if you have already used the paid tier. If you withdraw, we refund the amount paid less the part proportionate to the period you actually benefited from, calculated on the total contract price (Article 14(5)). Example: a monthly subscription of 100 lei, withdrawal on day five — we retain about 16.67 lei and refund about 83.33 lei.

For a promotion, if it has been displayed in full for the period purchased, the service is fully performed and the right of withdrawal lapses. If you withdraw earlier, we retain the part proportionate to the days already displayed.

If we got it wrong, you pay nothing

If we did not inform you correctly about the right of withdrawal, if we did not obtain the two express confirmations from you, or if we did not send you the order confirmation on a durable medium, then you owe nothing for the period already performed and we refund you in full. That is the rule in Article 14(6) of Emergency Ordinance no. 34/2014, and the burden of proving we met our information duties lies with us.

In addition, if we failed to inform you about the right of withdrawal at all, the 14-day period is extended by up to 12 months under Article 10.

How to withdraw

1. Simplest: use the form on this page, the "Retrageți-vă din contract aici" button. It asks for your name, the order you are withdrawing from and the e-mail address at which to receive confirmation, then asks you to press "Confirmați retragerea". Immediately afterwards you receive an acknowledgement by e-mail, with the content of your declaration and the date and time you submitted it.
2. Or: send any unequivocal statement to contact@smalljobs.ro making clear that you are withdrawing. You may use the model form below, but you are not obliged to.
3. Or: send the statement by post to SMALLJOBS S.R.L., Str. Progresului nr. 43, Simeria, Hunedoara County, 335900, Romania.

It is enough that you send the statement before the 14 days expire. What matters is when you sent it, not when we received it.

Refunds

We refund the sums due within no more than 14 days of being informed of your decision, using the same means of payment you used at purchase, unless you agree otherwise. We charge no fee for the refund.

If we disagree

If we reject your withdrawal request or you are not satisfied with how we handled it, you may refer the matter to the alternative dispute resolution entity within ANPC, through the SAL electronic platform at https://reclamatiisal.anpc.ro. We undertake to take part in that procedure. You may also bring proceedings before the court of your own domicile.
